Legal notice, privacy notice and terms governing the Faderr13 product and the faderr13.com website.
← Back to appFaderr13 is a personal in-ear monitor (IEM) controller for live-stage musicians. It connects to a DiGiCo SD or Quantum mixing console via the OSC protocol over the local network. Each musician adjusts their own monitor mix from their personal smartphone, while the monitor or front-of-house engineer retains full and immediate control of the console at all times.
The product consists of a hardware unit — the Faderr13Box, based on Raspberry Pi — installed at the customer's premises, and a companion musician application that runs on the musician's own device. The musician application is and will remain free of charge for end-user musicians and is distributed in two complementary forms: (i) a Progressive Web Application (PWA) loaded directly from the Faderr13Box over the local network, and (ii) native applications for iOS (Apple App Store) and Android (Google Play). The free nature of the musician application is part of the Faderr13 commercial model: Eighty6 SRL's revenue comes from the one-time sale of Faderr13Box units and of Faderr13OS software licences (perpetual licences acquired for a one-time price — see Section 11) to B2B customers, not from end-user musicians.

Hosting. This legal page is published from eighty6.be, the corporate site of the publisher Eighty6 SRL. Both eighty6.be and faderr13.com are hosted by OVH SAS, a simplified joint-stock company incorporated under French law, registered office at 2 rue Kellermann, 59100 Roubaix, France, registered with the Lille Métropole Trade and Companies Register under number 424 761 419. The Faderr13 software itself runs on the customer's own Faderr13Box on the customer's local network. No personal data of musicians transits servers operated by Eighty6 SRL.
This notice is issued under Articles 13 and 14 of Regulation (EU) 2016/679 (the "GDPR") and the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.
The architecture of Faderr13 is deliberately local: the Faderr13Box is installed and operated by the B2B customer (the venue, sound provider or production company) on the customer's own local area network. Musician identifiers and access PINs are entered by, stored on, and accessed solely by that customer's installation. Eighty6 SRL has no technical access to that data.
Accordingly, with respect to data processed on the Faderr13Box:
Eighty6 SRL acts as controller only for the limited personal data it processes itself, namely: business contact details of professional customers and prospects (account management, quoting, billing, support correspondence), and basic technical logs of the faderr13.com marketing website. The lawful basis is contract performance (Art. 6(1)(b) GDPR), legitimate interest in operating and securing the website (Art. 6(1)(f)) and legal obligations (Art. 6(1)(c), in particular accounting law).
The Faderr13 PWA stores the following information locally on the musician's device, exclusively in the browser's localStorage:
None of this information is transmitted to Eighty6 SRL or to any third party. The musician can erase it at any time by clearing the site data in their browser or by removing the PWA from the home screen.
The retention period of this data is determined by the B2B customer, who must inform the musicians and provide them with the rights described below.
Neither faderr13.com (beyond strictly necessary technical cookies, if any) nor the Faderr13 PWA use third-party analytics, advertising, retargeting, fingerprinting, or behavioural tracking.
For data of which Eighty6 SRL is controller (Section 3.1, last paragraph), you may exercise the rights of access, rectification, erasure, restriction, objection and data portability provided by Articles 15 to 22 GDPR, and the right to withdraw any consent at any time, by writing to support@faderr13.com with the subject "GDPR". A reply will be provided within the one-month period set by Article 12(3) GDPR.
For data processed on a Faderr13Box, please contact the customer operating that box (your venue or production company), who is the controller.
You may at any time lodge a complaint with the Belgian Data Protection Authority — Autorité de protection des données / Gegevensbeschermingsautoriteit, Rue de la Presse 35, 1000 Brussels, dataprotectionauthority.be.
Recommendations:
Nothing in this section is intended to exclude or limit any liability that cannot be excluded or limited under applicable law. In particular, Eighty6 SRL does not exclude or limit its liability for death or personal injury where such liability arises under the Belgian product-liability regime (Book IX of the Code of Economic Law and the Act of 25 February 1991, transposing Directive 85/374/EEC, as updated by Directive (EU) 2024/2853 once transposed), nor for fraud, intentional fault or gross negligence. Within those limits, Faderr13 is a control surface for the customer's mixing console; it does not override the console's own limiters and protection systems. The B2B customer is responsible for configuring and maintaining the audio-safety chain (limiters, output ceilings) on the console feeding the IEMs (see Section 9).
Faderr13 is a comfort tool for live performance. It is not a safety-critical system. Operation depends on third-party components outside Eighty6 SRL's control, including the local Wi-Fi network, the electrical supply, the customer's switches and access points, the DiGiCo mixing console and its firmware, the musician's smartphone hardware, operating system and browser, and the in-ear monitor system.
The sound engineer must, at all times, remain able to take direct manual control of all monitor sends on the mixing console. The performance must be capable of continuing without Faderr13 in the event of any failure of any component.
The legal warranty for hidden defects under Articles 1641 et seq. of the Belgian Civil Code applies to the sale of the Faderr13Box. Between professionals, this warranty may be limited to defects of which Eighty6 SRL was actually aware, to the maximum extent permitted by Belgian case law applicable to professional sellers. The legal conformity guarantee for consumer goods (currently codified, following the Act of 20 March 2022, in Articles 1649bis et seq. of the Civil Code, transposing Directive (EU) 2019/771) applies in full and is not waived where the buyer is a consumer.
Subject to the imperative provisions referred to below, the Faderr13 software (firmware on the Faderr13Box and the mobile PWA) is supplied "as-is" and "as-available". Eighty6 SRL does not warrant that the software will be free from all defects, that it will be uninterrupted, that it will be compatible with every configuration of mixing console, network, operating system, browser or device, or that it will meet the customer's specific requirements.
This clause does not derogate from, and is read subject to:
To the maximum extent permitted by applicable Belgian and EU law:
The above limitations do not apply to, and Eighty6 SRL's liability is not excluded or limited for:
The user, whether a B2B customer or an end-user musician, agrees not to:
Acts of decompilation, observation, study and testing that are expressly authorised by Articles XI.299 and XI.300 of the Code of Economic Law (transposing Articles 5 and 6 of Directive 2009/24/EC) are not restricted; the limits of those provisions remain in force.
The B2B customer (the entity that purchases and operates the Faderr13Box) is responsible for:
The B2B customer shall defend, indemnify and hold harmless Eighty6 SRL against any third-party claim arising from (i) the customer's breach of these terms, (ii) the customer's misuse of the product, or (iii) the customer's failure to comply with applicable law in its capacity as data controller or as employer/principal of its sound staff. This indemnity does not extend to claims caused by Eighty6 SRL's fraud, intentional fault, gross negligence or breach of an essential obligation, nor to claims falling under the mandatory product-liability regime.
The customer is solely responsible for backing up the Faderr13Box configuration. Eighty6 SRL does not store any copy of the customer's configuration on its own infrastructure. In the event of hardware failure, software corruption, accidental deletion, theft or any other loss of data on the Faderr13Box, Eighty6 SRL is under no obligation to restore the configuration.
Subject to payment of the purchase price (whether for a Faderr13Box or a Faderr13OS software licence) and to compliance with these terms, Eighty6 SRL grants the B2B customer a non-exclusive, non-transferable, non-sublicensable, revocable, perpetual licence to use the Faderr13 software:
In both cases the licence is for the customer's own internal professional use. It covers the firmware version installed or supplied at delivery and any subsequent firmware updates that the customer chooses to apply. Where Eighty6 SRL offers paid upgrades or extended services, those are subject to separate terms communicated at the time of purchase and do not affect the customer's perpetual licence to use the version originally delivered.
For Faderr13OS software-only licences, the customer is solely responsible for the Raspberry Pi hardware, its enclosure, its power supply, its network configuration, and its compliance with applicable safety and electromagnetic standards in the customer's jurisdiction. Eighty6 SRL provides best-effort firmware support but no hardware support for customer-supplied Raspberry Pi units.
Faderr13OS Download is digital content supplied electronically and delivered immediately after payment (download link and, upon communication of the device serial, a board-bound activation key). By completing the purchase, the buyer expressly consents to immediate performance and acknowledges losing the right of withdrawal under Article 16(m) of Directive 2011/83/EU (and its Belgian transposition, Art. VI.53, 13° CDE) once delivery has begun. The licence is granted for the single hardware board whose serial number is communicated at activation; it is non-transferable except with our written consent. VAT is applied according to the rules for electronically supplied services (Belgian VAT for Belgian buyers, OSS for EU consumers, reverse charge for EU businesses with a valid VAT number, zero-rated for non-EU buyers). Support for the Download edition is limited to the firmware and to hardware strictly conforming to the published compatibility list, for 30 days from delivery.
This licence does not grant any right to: access the source code; modify, adapt, translate or create derivative works; redistribute or sublicense the software; or commercially exploit it beyond ordinary use of the product as intended.
Nothing in this licence restricts the user's mandatory rights under Articles XI.299 and XI.300 of the Belgian Code of Economic Law (Computer Programs), including the rights to observe, study and test the functioning of the program and to perform acts of decompilation strictly necessary to obtain the information required to achieve interoperability of independently created programs, within the limits laid down in those provisions.
End-user musicians are granted a separate, free, personal, non-exclusive, revocable licence to install and use the Faderr13 musician application — in any of its distributed forms (PWA, iOS App Store, Google Play) — on their own device, solely for the purpose of controlling their own monitor mix on an authorised Faderr13Box. When obtained through the Apple App Store or Google Play, the application is additionally governed by the applicable store terms; in the event of conflict between those store terms and the present licence on a point of consumer protection, the rule more favourable to the musician prevails.
All elements of Faderr13 — including the firmware, the PWA, the website, the documentation, the user interface, the graphic design, and any associated content — are the exclusive property of Eighty6 SRL or its licensors and are protected by Belgian and EU copyright, database and intellectual-property law.
"Faderr13" is an unregistered trademark and trade name of Eighty6 SRL. No application for registration of the "Faderr13" trademark has been filed at the European Union Intellectual Property Office (EUIPO) or at the Benelux Office for Intellectual Property (BOIP) at the date of publication of this notice. As an unregistered sign, "Faderr13" is protected under Belgian unfair-competition law (Articles VI.104 and VI.193 et seq. of the Code of Economic Law) and Article 8 of the Paris Convention for the Protection of Industrial Property. The symbol ® is not used and shall not be used in relation to "Faderr13" until and unless a corresponding trademark registration is obtained.
All rights not expressly granted in these terms are reserved.
Compatibility with DiGiCo consoles. Faderr13 communicates with DiGiCo SD and Quantum mixing consoles via the publicly documented "External Control / Generic OSC" interface exposed by the DiGiCo console firmware (formally opened to third-party OSC integration by DiGiCo Ltd in 2018). Eighty6 SRL has not reverse-engineered, decompiled, or redistributed any DiGiCo software or firmware. References to "DiGiCo", "SD" and "Quantum" in Faderr13 materials are descriptive and serve solely to indicate the consoles with which Faderr13 is technically compatible, in accordance with Article 14 of Regulation (EU) 2017/1001 on the EU Trade Mark, Section 11(2) of the UK Trade Marks Act 1994, and analogous provisions of Belgian trademark law. "DiGiCo" and "Quantum" are registered trademarks of DiGiCo (UK) Ltd.; "SD" is a product designation of DiGiCo (UK) Ltd. Faderr13 is an independent product and is not affiliated with, endorsed by, or sponsored by DiGiCo (UK) Ltd.
Dependency on the DiGiCo OSC interface. Faderr13's core function relies on DiGiCo (UK) Ltd. continuing to expose, and to permit third-party use of, the "External Control / Generic OSC" interface, which is controlled exclusively by DiGiCo (UK) Ltd. and lies outside Eighty6 SRL's control (consistent with Section 5). Faderr13 is supplied as a one-time purchase under a perpetual licence (Section 11), by way of a single act of supply, not as a continuously supplied service; beyond the legal guarantees referred to in Section 6, Eighty6 SRL assumes no ongoing obligation to keep Faderr13 compatible with third-party systems. Should DiGiCo restrict, modify, withdraw or otherwise change the availability of this interface or its access policy — whether through a future firmware release, configuration change or licensing decision — Faderr13 may cease to function, in whole or in part, on the affected console models. Such a change is a supervening event external to the Faderr13 product, arising after the time of sale, and is not a hidden defect existing at the time of sale within the meaning of Articles 1641 et seq. of the Civil Code. Where such a restriction has been publicly announced by DiGiCo before a given sale, Eighty6 SRL will disclose it on the product page and in the relevant quotation or order confirmation before the contract is concluded. To the maximum extent permitted by applicable law, and subject to the remainder of this paragraph, Eighty6 SRL shall not be liable for, and no refund shall be due in respect of, any loss of function so caused. Where such a change permanently disables the core function on a given console model, Eighty6 SRL will treat it as an end-of-support event for that model under Section 13; where the change occurs without sufficient advance warning from DiGiCo, the notice given by Eighty6 SRL will be such as is reasonably practicable in the circumstances, which may be shorter than the notice period stated in Section 13. Eighty6 SRL will use reasonable efforts to restore compatibility through a software update where technically and legally possible, without guarantee of success. The foregoing does not exclude or limit Eighty6 SRL's liability for fraud, intentional fault, gross negligence or non-performance of an essential obligation (Article VI.91/5, 6° of the Code of Economic Law), nor does it derogate from any mandatory right of a consumer under the legal guarantee of conformity for digital content and digital services (Directive (EU) 2019/770) or for goods (Directive (EU) 2019/771), which continue to apply in full to the free musician application and, where applicable, to consumer buyers.
Software updates (bug fixes, security patches, new features) are provided at the discretion of Eighty6 SRL. The customer is encouraged to install security-related updates promptly. Eighty6 SRL may, on reasonable notice and in any event no less than six (6) months in advance for non-security reasons, discontinue support for a given hardware generation, mobile operating-system version, DiGiCo console model or browser version. Where discontinuation results from a decision of a third party outside Eighty6 SRL's control — such as a change to a console manufacturer's third-party control interface (see Section 12) — Eighty6 SRL will give such notice as is reasonably practicable in the circumstances, which may be shorter than six (6) months. After end-of-support, the product may continue to function but will no longer receive updates.
Faderr13 is offered under two complementary contractual frameworks:
A copy of the complete B2B Terms of Sale is available on request at support@faderr13.com.
End-user musicians acting outside the course of a professional activity, who consider that an issue with Faderr13 was not satisfactorily resolved by Eighty6 SRL, may refer the matter to the Belgian Consumer Mediation Service (Service de médiation pour le consommateur / Consumentenombudsdienst), Boulevard du Roi Albert II 8 box 1, 1000 Brussels, mediationconsommateur.be — the federal residual ADR body designated under Book XVI of the Code of Economic Law. Reference to the discontinued EU Online Dispute Resolution platform (Regulation (EU) 524/2013, repealed with effect from 20 July 2025) is not included as it is no longer operative.
These terms and any non-contractual obligations arising in connection with them are governed by the laws of Belgium, to the exclusion of its conflict-of-laws rules and of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For B2B disputes, the parties confer exclusive jurisdiction on the Tribunal de l'entreprise du Hainaut, division de Charleroi, in accordance with Article 25 of Regulation (EU) No 1215/2012 ("Brussels Ia").
For disputes involving a consumer (notably an end-user musician acting outside their professional activity), this clause is without prejudice to the mandatory rules of jurisdiction set out in Articles 17 to 19 of Brussels Ia and to the consumer-protection rules of the consumer's habitual residence under Article 6 of Regulation (EC) No 593/2008 ("Rome I"), which continue to apply.
Eighty6 SRL may update this document from time to time to reflect changes in the product, the law or its business. The current version is always available at eighty6.be/faderr13/legal.html. The date of the latest update is shown at the bottom of this page. Material changes affecting active B2B customers will be communicated by email at least thirty (30) days before they take effect.
